Privacy Policy Your Corner 360 website 

 This Privacy Policy sets out the policy of YCG Legal Pty Ltd ACN 660 178 003, YCG Wealth Management Pty. Limited ACN 622 775 375 and YCG Accounting Pty Limited ACN 623 271 241 (YC360) on the collection, handling and use of any personal information that its officers, representatives and employees collect or obtain about individuals including clients, potential clients and shareholders.  YC360 recognizes the importance of privacy and we are committed to ensuring the privacy of your personal information.  

 This policy explains the steps we will take to ensure that we comply with the Privacy Act 1998 (Cth) (Privacy Act) and the Australian Privacy Principles (APP) at all times when handling personal information.                    

 

Personal information collection 

In this policy, personal information is any information that could identify you or be used to establish your identity.  

We will only collect personal information that is reasonably necessary in order to understand and meet clients’ financial and business needs as part of the delivery of our services. This personal information is also collected, held, used and may be disclosed by us to enable us to comply with our legal and regulatory obligations.   

You consent to us performing verification of identity checks using third party providers to verify your identity where you are a client of YC360, to share those identity checks with other providers where required as part of the services we are providing to you, and to retain that information for as long as legally necessary. 

Most of the personal information we collect will be directly from you.  We gather this information either through application forms or other forms that you complete and submit to us (in writing and digitally) and by recording the information you provide via phone calls and interviews.  In some cases, we may collect your personal information from external sources.  Examples of the people or organisations that may provide us with information are: 

  • persons authorised by you, for example lawyers or accountants; 
  • parents or guardians in respect of children; 
  • other credit providers; 
  • public sources of information; 
  • third-party brokers, for example insurance and mortgage brokers;
  • and credit reporting bodies. 

    We only collect information from external sources if it is impractical to collect it directly from you, or when we are permitted to do so. 

    We will notify you if we intend to collect personal information from third parties and will only collect this information with your consent. The information we collect depends on the type of product or service we provide to you. It may include: 

    • name, address and contact details; 
    • date of birth, age and your intended plans for retirement; 
    • financial goals, needs, objectives and circumstances; 
    • details of your dependants and beneficiaries; 
    • financial information including income, assets and liabilities, account balances, tax and financial statements (for the purpose of preparing a statement of advice);
    • employment details; 
    • domicile and citizenship status; 
    • information regarding your health (only where necessary for some types of insurances); 
    • your tax file number (where you have given it to us, noting that you are permitted to decline the provision of this information but it may result in tax being withheld or have other consequences on our ability to provide our services to you); 
    • insurance claim information; and 
    • identification documentation (which, in some cases, we are required to collect by law). 

    We do not collect sensitive information unless required by applicable law or rules, or you have consented to it. Sensitive information includes information relating to race, political or religious beliefs, sexual preferences, criminal convictions, membership of professional or trade associations or unions and health information. 

    Where payments are made using the website, a secure payment provider will be used and no credit card information or payment information will be collected or stored on the website or by YC360 at any time. 

     

    Will my personal information be used for direct marketing? 

    We use and disclose your personal information to keep you informed about the range of financial products and services offered by us.  You can opt out of receiving direct marketing from us at any time, using the contact details set out in this policy. 

    Do I need to provide my personal information? 

    It’s your choice whether to provide your personal information to us.  If you don’t, we might not be able to recommend a specific product or service to you, it may affect our ability to properly analyse your personal circumstances and it may impact on our ability to provide our services to you. 

     

    Use of your personal information 

     We collect and use your information so we can: 

    • confirm your identity (including the use of third party verification of identity providers for all YC360 clients); 
    • provide our services to you and be assured that your identity has been verified; 
    • assess your application for a product or service including your risk tolerance; 
    • design, manage, price and provide our products and services; 
    • manage our relationship with you; 
    • minimise risks and identify or investigate fraud and other illegal activities; 
    • contact you; 
    • improve our service to you and your experience with us; 
    • comply with laws, and assist government or law enforcement agencies; and 
    • manage our business. 

        We may also use and disclose your information for purposes related to the provision of these services such as: 

        • assisting with your questions and complaints; 
        • arranging for services to be provided by third parties; 
        • enhancing our customer service and product options; and 
        • internal operations such as record keeping, data analysis, auditing and training.  

         

        Disclosure of personal information 

        We do not sell, trade, or rent your personal information to others. We may need to provide your information, including but not limited to, our professional advisers, external dispute resolution schemes, platforms, accountants, regulators (ASIC, ATO, AUSTRAC, etc) and contractors who supply services to us, for example to handle mailings on our behalf or to other companies in the event of a corporate sale, merger, reorganisation, dissolution or similar event. We only use and disclose personal information about you for the purpose for which it was disclosed to us and for related purposes which are reasonably necessary. However, we will use reasonable steps to ensure that they protect your information in the same way that we do. 

        We may provide your information to others if we are required to do so by law or under some other circumstances which the Privacy Act permits.  

         We may pass on your information to any of our Authorised Representatives in order to provide further financial or other services and products relevant to you.  

        Some of the entities that we share information with may be located in, or have operations in, other countries.  Information may also be disclosed to overseas entities when it is reasonably necessary for the provision of financial products and services.  This means that your information might end up stored or accessed in overseas countries including the Philippines and Vietnam.   When we send your personal information to overseas recipients, we take reasonable steps to ensure that appropriate data handling and security arrangements are in place to keep that information secure.   

         

        Quality of personal information 

        It is in our interests to ensure that the personal information that we have about you is accurate, complete and up-to-date. To assist us with this, please advise us if you believe that any of the information that we have about you is not accurate, complete or up-to-date and all reasonable efforts will be made to correct your information. 

         

        Personal information security 

        We will hold your personal information electronically using a secure electronic data system based in Sydney as well as a combination of secure computer storage facilities, paper-based files and other formats.   

        We are committed to keeping your information secure. We use all reasonable steps to protect the information from misuse and loss, and from unauthorized access, modification and disclosure.  These include instructing our staff and financial advisers who handle personal information to respect the confidentiality of customer information and the privacy of individuals. 

        We aim to keep personal information only for as long as we need it.  When this information is no longer required, we will take reasonable steps to delete it, destroy it or permanently de-identify it. We hold the information we collect from you in your client files and /or electronically for a period of 7 years. If you cease to be associated with us we will maintain your information in a secure manner for 7 years. After this time, your information will be securely destroyed. 

         

        Anonymity and pseudonymity 

        Where practical and within the law, you will be given an option to not identify yourself or use a pseudonym.  However, it is important to note that in many instances it will not be possible for us to assist you with your specific needs if you wish to remain anonymous or use a pseudonym.   

         

        Access to personal information and correction 

        You have a right to access or to seek correction of your personal information. Upon receipt of your written request and enough information to allow us to identify the information, we will disclose to you the personal information we hold about you. We will also correct, amend or delete any personal information that we agree is inaccurate. If you wish to access or correct your personal information, please contact our Privacy Officer

           You can access the personal and credit information that we hold about you by calling, emailing or writing to us (see the contact details within this policy).  We will respond as soon as practicable and in any event within 30 days.  If it is going to take longer than 30 days to complete your request, we will be in touch to let you know and to ask for more time. 

          There are some situations where we are allowed to refuse or limit your access to information, for example when the information is commercially sensitive or falls within legal professional privilege.  If this is the case, we will write to you and let you know. 

          There is no charge for making a request to access your personal information.  However, in some instances there may be a charge to cover the time spent locating, compiling and explaining the requested information.   If there is a charge, we will let you know the estimated cost before we start so you can confirm whether you wish to proceed with your request.

          What are interactive tools and how do we use them? 

          Our websites and mobile device applications may provide you with many interactive tools designed to help you make an informed choice with certain financial and other decisions. Some of these tools include budget planners, debt reduction calculators, home loan comparison, key factsheets and superannuation calculators. 

          We may collect personal information you enter when using the interactive tools on our website or through our applications. 

           

          What are cookies and how do we use them?

          Website analytics measurement software is used to assist in tracking traffic patterns to and from our websites, anonymously surveying users of the sites. The system is used to collect such information as the number of unique visitors, how long these visitors spend on the website when they do visit, and common entry and exit points into and from the website. 

          This non-personal information is collected and aggregated by third party software and provided to us to assist in our analysis of our websites. You cannot be identified personally from this information and no personal information is stored about you.

          By accessing this website, asking us to assist with your needs or becoming a client of YC360, you consent to the collection and use of the personal and other information you have provided to us for the purposes described above.

          This Policy is effective as of 24 February 2023.  We will update this policy on our website when our information handling practices change, and any amendments will apply to the information we hold at the time of the update.
